THE IMPROVEMENT OF PROCESSES OF COMMERCIALIZATION OF OBJECTS OF INTELLECTUAL PROPERTY RIGHTS IN THE COMPUTER TECHNOLOGIES
Abstract
The economic and legal system for protecting computer technologies in Ukraine and the United States of America is considered. It was discovered that the United States was the first to protect computer programs as an object of copyright. The contribution of the information technology sector to the country’s gross domestic product (GDP) has quadrupled over four years: from 1% in 2012 to 4% in 2018. During the analysis of the global software market, the share of the Ukrainian market for the provision of IT-services was determined. The characteristic of commercialization of software in Ukraine is presented. It is proved that the main partners of Ukraine in the export of IT-service are the United States (31%), the United Kingdom (23%) and others (46%): Germany, Canada, Israel, Sweden, and Switzerland. The volumes of investments in the development of the IT industry of Ukraine were demounted, which amounted to $ 120 million in total in 2016, $265 million in 2017, and $295 million in 2018. The demand for Ukrainian outsourcing companies that provide patent-licensing activities at enterprises both in their country and abroad is analyzed. In 2018, 12 Ukrainian companies and 6 companies with Ukrainian representatives were included in the top-100 leaders in the rating “The 2018 Global Outsourcing 100”. Although the Ukrainian market has a positive trend in the export of software products, still Ukrainian companies do not have a significant number of orders in the international market. In the course of analysis of the research of the Association of Software Manufacturers, it was found that in Ukraine only 20% of licensed software, the remaining 80% are licenses that are illegal. It is proposed to improve the current legislation of Ukraine on the protection of intellectual property in the field of computer technology, which will not only prevent numerous violations of the illegal use of computer programs, but also ensure significant development of the country in the field of computer technology as a whole and increase the ability of the state to take pride of place in Europe among exporters computer technology.
