ORGANIZATIONAL AND LEGAL ASPECTS OF THE APPLICATION OF THE CONCEPT OF CIRCULAR ECONOMY AT THE LOCAL LEVEL

Abstract

The article examines and analyzes the main program documents on the circular economy in Ukraine. The National Waste Management Strategy of Ukraine until 2030 has been analyzed, which provides for the implementation in the state of the best European practices in the field of handling various types of waste (industrial, solid household, agribusiness waste, construction, hazardous and other types of waste). The main directions of state regulation in the field of waste management are determined, taking into account European approaches. It was determined that the tools for implementing the National Waste Management Strategy of Ukraine until 2030 are waste management plans, which are developed at three main levels of public management: national, regional and local. The article presents the author's critical position regarding the processes of preparation and development of these plans at all levels of the administrative-territorial system. A recommendation was made for communities to join efforts to solve waste problems, for example, based on the use of a cluster approach, creating clusters of 5-7 communities, to build a waste management system. In order to organize the regulatory and legal support that will have to be worked with, as part of the development of relevant waste management plans, territorial communities are offered to use a certain algorithm of actions. Problems that territorial communities may face during the development of waste management action plans are highlighted. Recommendations have been developed to prevent and solve the above-mentioned potential problems for territorial communities. It was concluded that ensuring the sustainable development of territorial communities in the context of the transformation of its economic system to a circular type will inevitably lead to changes in the economic, social, and ecological systems and will require certain legal and organizational measures. It has been proven that institutional changes are an integral part of the entire process of transformation of the economic system, because without reforming the legal framework and implementing a number of other organizational measures, activities in the field of changing the economic system to a circular type and promoting further popularization and development of its basic principles are impossible. This was achieved with the help of general scientific methods (system analysis, formalization) and methods of economic and statistical analysis (graphical, grouping). The practical value of the conducted research is the development of specific recommendations that will allow, in the event of their application, to reduce the amount of extraction of primary resources, to increase the efficiency of the use of already used resources, and to increase the level of technological and socio-economic development in the areas.
